Terms of Service

Last updated: May 16, 2026

Welcome to Gear Box Marketplace LLC ("Gearbox Marketplace," "we," "us"). By using Gearbox Marketplace, you agree to these Terms of Service. If you don't agree, don't use the site.

Who Can Use Gearbox

You must be 18 or older to sell or buy on Gearbox. If you're under 18, you may use the site only with a parent or legal guardian who accepts these terms on your behalf.

What You Can Sell

Music gear only. Gearbox is a marketplace for musical instruments, recording equipment, pro audio, DJ gear, and related accessories. If it's not music-related, it doesn't belong here. We may remove listings that violate this rule without notice.

List it honestly. Your listings must include:

  • Accurate descriptions of condition (new, mint, excellent, good, fair, parts_only)
  • Real photos of the actual item — no stock photos unless you're an authorized dealer using official product images
  • Correct brand, model, and specifications
  • Honest disclosure of any defects, repairs, or modifications

We may remove listings that are materially misleading, and repeat violations may result in account suspension.

The Sale Is Binding

When a buyer commits to purchase:

  • Sellers must ship the item as described in the listing, within 3 business days of receiving payment. If you don't ship in time, Gearbox may issue a refund to the buyer on your behalf and charge your payment method for the order total.
  • Buyers must pay within the timeframe specified at checkout.

We don't tolerate fraud, chargebacks without cause, or manipulation of the platform to avoid fees.

Complete All Transactions on Gearbox

All sales must be completed through Gearbox. Do not:

  • Ask buyers to pay outside the platform
  • Offer alternative payment methods
  • Complete transactions in a way that bypasses Gearbox's payment processing

This protects both parties — Gearbox's payment system is how we verify transactions, resolve disputes, and keep your data secure. Off-site transactions are a violation of these terms and may result in account termination.

Cancellations

Seller-initiated cancellations create a poor experience for buyers and may result in:

  • A strike on your seller account
  • Reduced visibility in search results
  • Account suspension if cancellations become a pattern

If you cannot fulfill a sale, cancel immediately so the buyer can find another seller. Do not accept orders you cannot fulfill.

Prohibited Items

The following items may not be listed on Gearbox:

  • Counterfeit or fake instruments, gear, or accessories
  • Stolen property
  • Items that are not music-related (see "What You Can Sell" above)
  • Preloaded digital media (sample packs, DAW plugins with license keys already activated)
  • Anything that violates applicable law

Intellectual Property & DMCA

We respect intellectual property rights and respond to valid DMCA takedown notices.

If you believe your copyrighted work is being sold on Gearbox without authorization:

Send a written notice to our designated DMCA agent at legal@gearboxmarketplace.com including:

  • A description of the copyrighted work
  • A link to the infringing listing
  • Your contact information
  • A statement that you have a good-faith belief the use is not authorized
  • A statement under penalty of perjury that the information is accurate

We will remove or disable access to the listing promptly after receiving a valid notice.

If you believe your listing was wrongly removed, you may submit a counter-notice.

Repeat infringers may have their accounts terminated.

Account Suspension & Termination

Gearbox reserves the right to suspend or terminate accounts that:

  • Violate these terms
  • Engage in fraud or deceptive practices
  • Accumulate excessive cancellations or buyer disputes
  • List prohibited items
  • Attempt to conduct off-site transactions

We may do this with or without notice, at our discretion.

Liability Disclaimer

Gearbox Marketplace is a marketplace platform. We are not a party to the transaction between buyers and sellers.

We do not:

  • Guarantee the condition, authenticity, or legality of items sold
  • Provide warranties on products
  • Mediate disputes beyond our standard dispute resolution process

Sellers are responsible for accurately describing their items. Buyers are responsible for reviewing listings before purchasing. Use the messaging system, ask questions, and review photos carefully.

Disputes

If a dispute arises between a buyer and seller, Gearbox may review the facts and make a determination, including issuing refunds from the seller's payment account when warranted (e.g., item not as described, seller didn't ship).

Governing Law

These Terms of Service are governed by the laws of Ohio.

Changes to These Terms

We may update these terms from time to time. When we do, we'll update the "Last updated" date at the top. Significant changes will be communicated via email to affected users.
